Section 1

General Booking & Service

1.1: Slot Allocation All bookings are subject to the availability of the requested date, time, and physical inventory at the point of final confirmation.

1.2: Quotations Price quotes are estimates based on initial data and are valid for seven (7) days from the date of issuance. Final invoices reflect actual work performed and current market rates for parts and lubricants.

1.3: Stock & Promos BGarage reserves the right to adjust pricing or reschedule if specific parts are out of stock or if promotional conditions are not met.

1.4: Appointment Grace Period BGarage does not charge a cancellation fee. However, if the Customer does not confirm their attendance or fails to arrive within fifteen (15) minutes of the scheduled appointment time, the appointment slot will be automatically forfeited to accommodate other customers.

1.5: Security Deposit BGarage reserves the right to request a non-refundable deposit of up to 50% of the estimated quotation for jobs involving high-value spare parts or specialized labor before work commences.

Section 2

Pre-Inspection & Diagnostic Authorization

2.1: Consent to Inspect The Customer authorizes a comprehensive pre-inspection and diagnostic check to identify necessary repairs.

2.2: Pre-Existing Damage BGarage is not liable for pre-existing scratches, dents, or mechanical failures documented upon arrival.

2.3: Diagnostic Fees If the Customer chooses not to proceed with repairs after a diagnosis, a standard diagnostic/labour fee will apply.

Section 3

Authorization for Road Testing & Fuel

3.1: Test Drive Consent The Customer grants permission for authorized personnel to operate the vehicle on public roads for diagnostic testing and quality control.

3.2: Consumables The Customer must ensure sufficient fuel for testing. BGarage is not liable for the cost of fuel or consumables used during the testing phase.

Section 4

Pick N Drop Indemnity

4.1: Logistics BGarage will perform the pick-up and drop-off at the locations and times mutually agreed upon during the booking process.

4.2: Vehicle Suitability The Customer warrants the vehicle is in a safe and operable condition before handover. BGarage reserves the right to refuse service if the vehicle is deemed unsafe.

4.3: Personal Belongings Customers must remove all personal and valuable items. BGarage is not liable for the loss of any items left inside the vehicle.

4.4: Liability Waiver While BGarage will exercise reasonable care, the Customer acknowledges that the pick-and-drop service is used at their own risk. BGarage is not liable for unforeseen incidents including accidental damage, theft, fire, or force majeure.

4.5: Ownership Warranty The Customer warrants they are the registered owner or have express authority from the owner to submit the vehicle for service.

4.6: Indemnity The Customer agrees to indemnify BGarage against any legal actions arising from a lack of authority to authorize repairs or movement of the vehicle.

Section 5

Third-Party Authorized Panel

5.1: Specialized Partners To ensure high-quality repairs, BGarage may engage authorized trusted third-party partners for specialized or complex issues.

5.2: Responsibility BGarage remains responsible for overseeing the overall service quality of these partners.

5.3: Data Transfer The Customer consents to BGarage sharing relevant vehicle and contact data with these partners solely for the purpose of completing the requested repairs.

Section 6

Collection, Storage & Lien

6.1: Timely Collection Vehicles must be collected within 48 hours of completion notice.

6.2: External Parking & Liability If a vehicle is not collected within three (3) days of a quotation issuance or completion notice, BGarage reserves the right to move the vehicle to an external/public parking area to ensure workshop operation.

6.3: Right of Lien Under Malaysian law, BGarage reserves the right to retain the vehicle until all outstanding invoices are settled in cleared funds. The Customer acknowledges that a proof of transfer or screenshot may not suffice for the release of the vehicle until BGarage confirms receipt of payment in its bank account.

6.4: Transfer of Risk & Release of Liability BGarage shall only be held responsible for the safety and condition of the vehicle for a maximum period of three (3) days following the notification of completion. Effective from the fourth (4th) day onwards, all risks associated with the vehicle shall transfer entirely to the Customer.

Mechanical deterioration or battery failure due to prolonged inactivity.

Damage caused by environmental exposure, including sun, rain, or paint fading.

Loss or damage resulting from theft, vandalism, or fire.

Natural disasters or acts of God, including flash floods or storms.

The Customer agrees to indemnify BGarage against any claims arising from the vehicle being left on the premises beyond the stipulated three (3) day period.

6.5: Disposal of Uncollected Vehicles If a vehicle remains uncollected for a period exceeding three (3) months from the date of completion notice, BGarage reserves the right to dispose of or sell the vehicle via legal channels to recover outstanding repair costs and accumulated storage fees, provided that a final written notice has been issued to the Customer.

Section 7

Environmental & Safety Compliance

7.1: Waste Disposal A standard environmental fee applies for the legal handling of scheduled wastes, including used oil, filters, and batteries, in accordance with Malaysian Department of Environment regulations.

7.2: Part Disposal Replaced parts will be disposed of by BGarage unless the Customer requests to retain them at the time of vehicle handover.

Section 8

Data Protection (PDPA) & Marketing Consent

8.1: PDPA Compliance In accordance with the Personal Data Protection Act 2010, BGarage collects and processes your data for service fulfillment and internal record-keeping.

8.2: Marketing & Promotions By agreeing to these terms, the Customer grants BGarage permission to use their contact information, including Phone, Email, and WhatsApp, to send the following communications:

Service reminders and maintenance alerts.

Promotional offers, discounts, and newsletters.

Invitations to customer loyalty programs.

8.3: Opt-Out The Customer may opt out of marketing communications at any time by following the unsubscribe link in digital messages or by contacting the support team.

8.4: Media Rights The Customer grants BGarage the right to take photographs or videos of the vehicle for technical documentation or for use in BGarage social media and marketing materials, ensuring license plates are blurred or hidden where applicable.

Section 9

Warranty & Limitation of Liability

9.1: Workmanship Warranty A warranty is provided for the work performed, with terms depending on the specific spare parts used. Details will be provided upon completion.

9.2: Exclusion of Consequential Loss BGarage shall not be liable for any indirect or consequential losses, including but not limited to loss of income, loss of use of the vehicle, or travel expenses incurred while the vehicle is being serviced.

9.3: Parts Warranty Warranty for parts supplied by BGarage is governed strictly by the supplier or manufacturer terms. BGarage acts as a facilitator for these claims, and approval is at the supplier discretion.

9.4: Prohibition of Customer-Supplied Parts To ensure safety, liability protection, and workmanship standards, BGarage strictly prohibits the use of spare parts or lubricants supplied by the Customer. BGarage will only install parts sourced through its authorized supply chain.

9.5: Electronic Data BGarage is not liable for the loss of electronic data, radio presets, or custom ECU settings resulting from battery disconnection during service.

9.6: Staff Protection The Customer shall not privately engage or solicit any BGarage personnel for independent services for twelve (12) months following the service completion.

9.7: Limitation of Liability In the event of any damage arising from BGarage workmanship, BGarage liability shall be limited to the actual cost of repair or rectification required to restore the vehicle to its functional state prior to the service. BGarage shall not be liable for any third-party legal claims, loss of market value, or emotional distress beyond the physical restoration of the vehicle.

Section 10

Force Majeure & Liability Limits

10.1: Acts of God BGarage is not liable for damage caused by natural disasters, including but not limited to flash floods, storms, or other unforeseen environmental events.

10.2: Consequential Loss BGarage is not liable for indirect losses, such as loss of income or alternative transport costs.

10.3: Acts of God & External Factors BGarage is not liable for delays or damages caused by natural disasters, pandemics, government-imposed restrictions, or national power outages.

Section 11

Specific Terms for Electric (EV) & Hybrid Vehicles

11.1: High-Voltage System Authorization The Customer acknowledges that EV and Hybrid vehicles contain high-voltage components. The Customer authorizes BGarage certified technicians to perform necessary de-energizing, isolation, and testing procedures on the high-voltage battery and drive systems.

11.2: Battery State of Health (SOH) While BGarage will exercise due care, BGarage is not liable for the natural degradation of the traction battery state of health or sudden battery cell failure that may occur during or after the service, provided BGarage followed standard operating procedures.

11.3: Software & Firmware Updates EV and Hybrid vehicles frequently receive over-the-air or manual firmware updates. BGarage is not responsible for software glitches, loss of third-party apps, or bricking of electronic modules that may occur during manufacturer-mandated updates or diagnostic resets.

11.4: Charging Equipment & Accessories If the Customer provides a portable charging cable or adapter for use during the service, BGarage provides no warranty on such equipment and is not liable for any electrical faults or damages originating from the Customer's own charging accessories.

11.5: Thermal Risk & Safety Protocols In the event that a vehicle battery system is identified as unstable or a fire risk, the Customer authorizes BGarage to move the vehicle to a designated safe isolation zone. The Customer agrees to bear any specialized towing or storage costs associated with such safety protocols.

Section 12

Entire Agreement

12.1: Integration This Agreement constitutes the entire understanding between parties and supersedes all prior discussions, WhatsApp messages, or oral representations.

12.2: Amendments No amendment or variation of these terms shall be effective unless it is in writing and confirmed by BGarage.

Section 13

Governing Law

13.1 This Agreement is governed by the laws of Malaysia. Any disputes shall be resolved through mediation or arbitration as per BGarage company policy.
